Prostitution: A person can commit the offense of prostitution with mere words alone. Prostitution in §43.02 of the TEXAS PENAL CODE is defined as follows: A person commits the offense (prostitution) if he or she knowingly: 1. “offers to engage, agrees to engage, or engages in sexual conduct for a fee;” or 2. “solicits another in a public place to engage with him in sexual conduct for hire.”The criminal offense of Prostitution is established regardless of whether the person is soliciting another to engage in sexual conduct for hire, or offering to engage in sexual conduct for hire. Other Sex related Criminal offenses include, but are not limited to the following: Promotion of Prostitution, Aggravated Promotion of Prostitution, Obscene Display or Distribution, Obscenity.
