Drug Charges

Texas Controlled Substances statute is laid out in Health & Safety Code. The Texas Controlled Substances Act divides controlled substances into four penalty groups. It is a misdemeanor to possess four ounces or less of marijuana. Possession of several different types of prescriptions is also a misdemeanor. However, it is a Felony to possess any amount of most other “controlled substances.” These substances include cocaine, methamphetamine (ICE), & LSD. Punishment ranges vary depending on the amount possessed or delivered.
